These Terms of Service apply to your use of FreshBuilt Web websites, communications, services, and SMS messaging program. By using our website or services, or by opting in to receive SMS messages, you agree to the applicable terms below.
FreshBuilt Web services
FreshBuilt Web provides website design, setup, hosting-related assistance, and related business website services. Specific deliverables, pricing, timing, revisions, hosting terms, and payment requirements may be described on our website, order materials, invoice, or other written agreement. If a separate written agreement applies to a project, that agreement controls if it conflicts with these general terms.
FreshBuilt Web SMS messaging program
Program name: FreshBuilt Web. FreshBuilt Web may send SMS or MMS messages to customers and prospective customers who provide a mobile number and affirmatively opt in. Non-marketing messages may include service inquiries, follow-up communications, appointments, estimates, project updates, and customer support. Marketing messages may include special offers, discounts, and service updates when the recipient separately opts in to marketing messages.
Consent choices for marketing and non-marketing messages are separate. Consent to receive SMS messages is optional and is not a condition of purchasing or using FreshBuilt Web services.
Opt-out and rejoining instructions
You can cancel the SMS service at any time. Just text STOP to 404-999-5483. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this confirmation, you will no longer receive SMS messages from that program. If you want to join again, sign up as you did initially and we will resume sending SMS messages to you according to your new consent choices.

Carrier liability
Carriers are not liable for delayed or undelivered messages.
Message frequency, rates, and wireless-provider charges
Message frequency varies based on your interactions with FreshBuilt Web and the messaging program(s) you choose to join. Message and data rates may apply for messages sent to you from us and to us from you. If you have questions about your text plan or data plan, contact your wireless provider.
Privacy
If you have any questions regarding privacy, please read our Privacy Policy. Mobile information and SMS opt-in data and consent are handled in accordance with that policy and are not provided to third parties or affiliates for marketing or promotional purposes.
Industry standards and messaging compliance
FreshBuilt Web intends to operate its SMS messaging program in accordance with applicable carrier requirements and recognized industry standards for commercial messaging, including applicable CTIA guidelines and messaging-provider requirements.
Legal compliance
You and FreshBuilt Web are each responsible for complying with applicable federal, state, and local laws and regulations relevant to the use of the website, services, and SMS messaging program. FreshBuilt Web does not use its messaging program to send content that is unlawful or prohibited by applicable carrier or messaging-platform rules.
Eligibility and age restriction
You must be at least 18 years old to use FreshBuilt Web services or participate in our SMS messaging program. By providing a mobile number or using our services, you represent that you are at least 18 and are authorized to use the phone number or account you provide.
Your responsibilities
You agree to provide accurate information and to use our website and communications only for lawful purposes. If your mobile number changes or you no longer control a number you previously provided, please notify us or opt out so we can update our records.
Third-party services
FreshBuilt Web may rely on service providers for hosting, forms, communications, payments, domains, and other operational services. Your use of those services may also be subject to the provider's own terms and policies. We are not responsible for outages, delays, or failures caused by networks or service providers outside our reasonable control. SMS opt-in data and consent remain subject to the protections stated in our Privacy Policy.

We may update these Terms of Service from time to time. The current version will be posted on this page with the date of the latest update. Continued use of our services after an update constitutes acceptance of the revised terms to the extent permitted by law.
